Liability waiver

Assumption of risk, release & indemnification

In consideration of being permitted to participate in golf simulator sessions hosted by MMGolf, LLC ("Company"), I, the undersigned participant (and/or parent or legal guardian if participant is under 18), acknowledge and agree to the following:

1. Inherent risks. Swinging a golf club involves risk of personal injury, including but not limited to muscle strain, contact with the club, ball, screen, or other participants. I assume all such risks.
2. Equipment. I will use the equipment only as directed. I will not swing in a manner that may endanger others. Children under 12 must be supervised by an adult at all times.
3. Physical condition. I represent that I am physically fit to participate and have no medical condition that would make participation unsafe.
4. Release. I, my heirs and assigns, release and forever discharge Company, its owners, employees, and agents from any and all liability, claims, demands, or causes of action arising from my participation, except those resulting from Company's gross negligence or willful misconduct.
5. Indemnification. I agree to indemnify and hold harmless the Company against any claims brought by or on behalf of me or my guests arising out of my participation.
6. Media release. I consent to being photographed or recorded during my session for Company's marketing purposes, unless I notify the on-site crew otherwise.
7. Severability. If any portion of this waiver is held unenforceable, the remainder will remain in full force and effect.

By accepting this waiver during booking (or by signing the on-site waiver tablet on arrival), I confirm I have read and understood the above and accept its terms on behalf of myself and any minor participants in my party.
